    Hiring in a Competitive Marketplace - Pay Equity and Beyond

    Faced with new challenges to recruit and retain talent, employers are offering incentives, referral bonuses and other financial rewards to address the competitive marketplace. Before offering such incentives, employers should understand how incentives may impact wage and hour practices and take steps to develop compliant policies to minimize risk. Additionally, recent pay equity initiatives by state and local governments may impact employer hiring practices. For example, Illinois not only bans salary history inquiries, but recently enacted additional amendments to its pay equity law that will impose affirmative reporting obligations on some employers. Minnesota also has legislation pending similar to Illinois’ salary history ban. Employers need to understand their obligations, restrictions and reporting requirements, and develop strategies for creating enticing employment offers in a competitive marketplace. This session will discuss the following considerations for employers:

    • Understanding how financial incentives may impact wage and hour compliance (e.g., overtime)
    • Developing policies and procedures for establishing when such financial incentives become earned and payable
    • Understanding salary history bans and salary disclosure obligations
    • Developing pay/salary surveys for EEO-1 and equal pay compliance reporting
    • Preparing to defend your pay practices in litigation


    On the Horizon of Employment Law

    This session will get employers up to speed on recent and anticipated federal legislation, as well as major legislative trends you’re seeing at the state level. Doris Brosnan will address:

    • What employment law changes are ahead under the Biden Administration? Find out the key issues that are expected to impact employers.
    • What is the status of the minimum wage fight, both federally and in my state?
    • Update on new LGBTQ employment law changes since last year.
    • Paid maternity and other leave: Measures have support on both sides of the aisle, so what should employers be thinking about and planning for?
    • Changes in employment immigration laws: will there be changes that help?


    Returning to the Workplace

    The COVID-19 era changed the way we worked and offered a level of work-life flexibility and increased autonomy that many employees have not experienced. Many employers who never considered using teleworkers found it not only could work but provided some advantages. Returning and reintegrating employees can be complicated by the employee's willingness to return, accrued leave time, accommodation requests, financial constraints, and changing needs of the employer. In this session will discuss these issues and best practices, including the following areas:

    • Vaccinated Workplace
      • Can an employer ask about vaccination status?
      • Encouraging vaccination vs. mandating vaccination
    • Best practices for a return to work
      • Masks? Social distance? Small groups?
    • Alternative work scenarios
      • Continued telework
      • Alternate work schedules
      • Continue restricted travel and use of Zoom
    • Can employers be held liable for employees contracting COVID in the workplace?
