Introduction

Purpose.
As a consumer reporting agency governed by the Fair Credit Reporting Act (FCRA) and other applicable state and federal laws, MRA - The Management Association, Inc. (MRA) is committed to protecting your right to privacy. The purpose of this Background Checking Policy is to describe how MRA collects, uses, and shares information about you, both through our website located at www.mranet.org (collectively referred to herein as the “Site”) and otherwise. All information obtained by MRA will be collected, stored, and used in compliance with applicable laws, including the FCRA. Please read this notice carefully to understand what we do.     "Personally Identifiable Information" Gathered About You:

    We will only collect "Personally Identifiable Information" about you if you voluntarily choose to provide such information to us and/or in connection with a background check authorized by you and/or applicable laws. "Personally Identifiable Information" that we may collect about you through our website or otherwise may include, but is not limited to, name, address, email address, phone number, date of birth, birthplace, driver’s license number, social security number, employer, employment details, and information regarding prior criminal proceedings, civil proceedings, or credit activities. 

    Information Collected Through Google Analytics:

    We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of the Site. Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage.     If you interact with us on any social media platform:

    (i) depending on your social media privacy settings, the personal information that you submit on the social media platform may be read, collected, or used by us as described in this Privacy Policy, and
    (ii) where we respond to any interaction with you on social media, your account name/handle may be viewable by any and all members or users of our social media accounts. Social media platforms operate independently from MRA and we are not responsible for the personal information that you choose to submit or link on any social media platform. We encourage you to review the privacy policies and settings of any social media platform with which you interact to help you understand their privacy practices.

    No Information From Children Under Age 13:

    If you are under the age of 13, please do not attempt to register with us at this Site or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information.     How We Use Information

    Where we request "Personally Identifiable Information" from you, we will inform you of the purpose for collecting that information at the time of collection, and the information will be used only in the manner specified by us when it is collected unless you consent to another use. If you have provided "Personally Identifiable Information" to us in connection with a background check ordered by a client of ours, we may use such information to conduct a background check for that client. We will verify that our client has provided the necessary certifications under the FCRA and/or other applicable laws prior to using your information to conduct a background screening. Such certifications will include a statement that our client has a legally permissible purpose for ordering the background check and that it has, where appropriate under applicable law, obtained your informed consent to conduct the background screening.

    We will not disclose your personal information to a third party, except in accordance with applicable laws.

    Typically, we will only disclose personal information regarding the subject of a background check to a third party in the following situations:

    • To an employer or prospective employer who has been authorized by the consumer to receive information about him or her.
    • To a third-party representative or subcontractor of ours to assist in the background screening investigation (e.g. providers that support or host this website or otherwise provide technical assistance, as well as court researchers and other service vendors).
    • As otherwise required by law.

    When we transfer personal information to a representative or third-party subcontractor assisting with a background check, we provide only the information required to assist with the background check. We prohibit such third-party representatives and subcontractors from using consumer information for any purpose other than assisting us with the background check. We also contractually require such third-party representatives and subcontractors to maintain commercially reasonable measures to protect the confidentiality of consumer information they receive.

    Generally, we do not transfer information to third parties outside of the United States or its territories. Such transfers would be done if necessary to complete an international background check (e.g., conducting an international criminal check or verifying educational or employment records outside of the U.S.).

    If we or our assets are acquired by another company, that company will assume responsibility for the personal information collected by us through the website, and it will assume the rights and obligations regarding the collection and use of such information, as described in this Privacy Policy. We will not permit another business in such a circumstance to review or examine the information we have collected without a confidentiality agreement in place and only to the extent required by law.

You can opt-out of receiving marketing and promotional e-mails from MRA by using the opt-out or unsubscribe feature contained in the emails.

    If you are an MRA client with a registered account, you may review and update your information by logging into your account. If you are an individual on whom one of our clients has requested a background screening investigation, and you have submitted "Personally Identifiable Information" to us at the request of the client for purposes of the background screening investigation, you may review your MRA file in accordance with your file disclosure rights under the FCRA, California Civil Code Section 1786.22 or any other applicable law by contacting us at 800.488.4845, or in another legally authorized way.

    To protect consumers’ privacy and security, we will take reasonable steps to verify an individual’s identity before granting access to "Personally Identifiable Information" or allowing corrections to such data.
