This reference guide provides a brief comparison of leave requirements for the federal Family and Medical Leave Act (FMLA), Minnesota’s Sick and Safe Leave, Minnesota’s Pregnancy and Parental Leave Act, Minnesota’s Earned Sick and Safe Leave, and Minnesota’s Paid Family and Medical Leave. It is not intended to be, nor should it be viewed as an all-inclusive view of these laws. Always refer to specific laws or regulations for detailed descriptions of provisions and obligations and seek professional advice and counsel when notified of any pending agency investigation or potential charges claiming to be a violation of the law.

Employers must comply with any provisions of state or local law that provide greater family or medical leave rights than the rights established by the federal FMLA. Generally, FMLA and the MN Pregnancy and Parental Leave Act are taken concurrently. However, if a qualified employee has exhausted FMLA leave for reasons other than pregnancy, the employee could still be eligible under the MN Pregnancy and Parental Leave Act for an additional 12 weeks of leave.
