OSHA reinforced their stance that workplace safety incentive programs and post-accident drug testing is allowed and that OSHA does not intend to penalize the well-intentioned efforts by employers to minimize injuries on the job. If an employer’s action is for the legitimate purpose of promoting workplace safety and health, and not for penalizing an employee for reporting a work-related injury or illness, it is not a violation of the anti-retaliation provisions.
