An employer’s obligation to provide time off for voting varies from state to state. Employers must respond to requests for time off to vote based on the laws in place in the location where the employee works or according to an equally (or more) generous company policy.

Statement Regarding the Fair Labor Standards Act (FLSA): If local law does not require absences for voting and/or election duty to be paid, employers must ensure they follow federal and state FLSA rules for exempt employee partial day absences. Generally, this means an employer cannot deduct from an exempt employee’s pay for a partial day's absence.
