FLSA Compliance – Do your exempt positions meet the Duties Test?
Overview: With the proposed new minimum weekly wage for exempt status, and all of the fireworks and press surrounding its implementation, we need to remember that exempt status under the FLSA is not just about a minimum, guaranteed weekly salary. In addition to meeting the minimum weekly earnings, called the "wage test", positions must also pass what is referred to as the "duties test." This e-learning will review the duties tests associated with the most common workplace exempt statuses, including a discussion on the dreaded "exercise of discretion and independent judgment with respect to matters of significance" associated with the Administrative exemption category.
